Welcome to the Kid Command Web site located at www.kidcommand.com (the "Site"). Kid Command is owned, operated and presented to users by Green Bein’ Productions, Inc. of Lincoln, Nebraska, U.S.A. This Privacy Policy covers use of information collected by Kid Command.
We are committed to providing a fun, entertaining, educational online experience and safe website for persons of all ages. We are dedicated to safeguarding any personal information collected on the Kid Command Site. We ensure that our privacy policy and our information practices adhere to the United States Children's Online Privacy Protection Act and all other applicable legislation.
To help ensure a rewarding online experience for our members, we provide you, as that child’s parent or legal guardian, with this Privacy Policy that describes the information practices of the Kid Command Site, including the type of information we collect, and how we collect, use and disclose personal information.
Personal Information and Personal Financial Information
Whenever a child registers to be a “member” of the Kid Command website, we collect the following personally identifiable information (“Personal Information”) during our initial registration process: a parent's or legal guardian’s email address, the child's account name (the name of the Avatar), the child’s age and his or her password. In addition to this Personal Information, if a Kid Command child registrant acquires a paid membership, we may collect additional Personal Information from the child registrant's parent or legal guardian at the time the upgraded membership is purchased. Information collected for paid membership registration may include, without limitation, the parent's or legal guardian’s full name, email address, and credit card billing information including mailing address (“Personal Financial Information”). The Kid Command Site does not condition a child's participation in an online activity on the child providing more Personal Information than is reasonably necessary for that activity. We do not ask a child to provide any other data that would be considered Personal Information (such as the child’s name, street address, home phone, email or other such information). Nor must a child upgrade to a paid membership or have a parent or legal guardian provide Personal Financial Information in order to use the basic free Site and become a Kid Command member. The only Personal Information required for a free membership and general use of Kid Command Site is the valid email address of that member’s parent or legal guardian. If a registrant does not provide the initial required Personal Information for free registration, then that child may not become a member of Kid Command and may not be able to access certain content and functionality on the Kid Command Site, or receive other information if requested.
Passive Information
When you or your child visits our Site, we may passively collect certain non-personally identifiable computer information (“Passive Information”), such as the type of computer operating system used to access the Site (e.g., Windows XP or Mac OS), the user's IP Address, the web browser (e.g., Firefox, Internet Explorer), the frequency with which users visit various parts of our Site, and information regarding the Internet service provider. We collect Passive Information for use in our internal business and as research to help us improve the Kid Command Site and make the Site more interesting and useful to you and your child. We may collect Passive Information through the use of software technologies such as unique identifiers or "cookies." Cookies are small text files that we place in user’s computer browsers to store their preferences. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Netscape Navigator or Internet Explorer) settings. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you won't have access to many features that make your Kid Command experience smoother, and some of our services may not function properly. In addition to cookies, we also subscribe to the Google Analytics application which automatically tracks areas of our Site that a member uses. This helps us identify the most popular Site pages so that we can improve the overall experience for our members. The Google Analytics application does not track an individual member by identity and we will not have access to that information.
We use the Personal Information (the parent’s or legal guardian’s email address) to send you instructions on how to activate your child member’s Kid Command account. We may also send other email notices which may include information about our privacy practices, communications about your account and/or your child member’s Kid Command account, new Site features, special events coming to the Site, and information pertaining to any other purposes described in this Privacy Policy. Your email address is correlated with your child’s account user name. We may also request that a parent or legal guardian provide a user name and email address when your or your child member submits a form through the "Contact Us" portion of the Kid Command website so that we may respond to the inquiry. We collect the e-mail address at the time an inquiry is sent to us for the sole purpose of responding directly on a one-time basis to that specific inquiry. We ask that you not allow your child to provide his or her email address, only that of the parent or legal guardian.
For some of our online activities - such as polls or surveys - we may ask child members to provide information that is not personally identifiable, such as country of residence or a member’s favorite color. We also enable members to chat online through our Kid Command Site, but we take measures to ensure that members cannot communicate Personal Information through this chat function. These measures include the continuous use of filters that allow us to monitor content prior to enabling the content to be posted to the Site. We also, from time to time, moderate live discussions. In addition, no information provided in a chat room, poll, survey or other interactive feature of the Site will be made available to any Internet users outside of Kid Command members. Nonetheless, if you or your child uses the chat function within this Site to disclose Personal Information, please be aware that despite using our best efforts, we cannot guarantee that we will be able to catch every submission containing Personal Information. It is possible that such information could be missed despite filtering and monitoring activities, and that such information will be read, collected or used by other members. We are not responsible for the Personal Information you or your child chooses to submit through the chat function.
Finally, we may offer blogs or Public Forums (as defined in the “Terms of Use” governing the website) or other features on our Site, and you or your child may provide us with Submissions (as defined in the Terms of Use). You may access our Terms of Use at: http://www.kidcommand.com/terms-of-use.php. We will take the same protective measures described above to prevent a member from submitting Personal Information on a blog, Public Forum or other interactive Site feature. As noted, these measures include filtering communications before they are posted, and live moderation, which will be provided from time to time. In addition, we will post blogging rules, and through filtering efforts, we may delay blog posts for up to 24 hours from the time of submission, in order to prevent bloggers from posting Personal Information. If you or your child uses a blog or Public Forum on this website, and choose to disclose Personal Information, please be aware that despite using our best efforts, we cannot guarantee that we will be able to catch every submission containing Personal Information. It is possible that such information could be missed despite filtering and monitoring activities, and that such information will be read, collected or used by other members. We are not responsible for the Personal Information you or your child chooses to submit through a blog, Public Forum or other interactive Site feature.

However, we do not provide our corporate sponsors or any other third-party companies with the email addresses or other Personal Information of our members. Third-party companies are strictly prohibited from soliciting or sending advertising directly to our members. We do not disclose any Personal Information of any type gathered through Kid Command to any third party. We intend to keep Kid Command free from any direct advertising or solicitation of our members.
The security of your Personal Information and Personal Financial Information is important to us. We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online. When you enter sensitive information, such as your credit card number, or our membership subscription form, we encrypt that information using secure socket layer technology (SSL).
As noted in Section 1, if your child decides to purchase a paid membership, the parent's or legal guardian’s full name, email address, credit card billing information including mailing address will be required at the time of purchase. That Personal Financial Information is not stored by Kid Command, and, instead, is collected and stored by our payments processing vendor for the purpose of processing payments made to Kid Command. All Personal Financial Information is safeguarded with appropriate security, and it will not be used for other purposes. Furthermore, our payments processing vendor has agreed to maintain the confidentiality, security, and integrity of the personal and financial information it obtains from the Kid Command website, and only to use this information on our behalf. All applicable privacy laws relating to the provision of financial services bind our financial institution.
Our Site is COPPA compliant. As part of our compliance with the COPPA rules and regulations, you have the right at any time to review any Personal Information disclosed by your child via the Site. Please contact our Privacy Director as provided in Section 7 if you would like to access the Personal Information that we have collected online from you or your child, correct factual errors in such information, request to have this information deleted, or request that we no longer collect or maintain such information. Please be sure to include your email address and a telephone number where we can reach you. To protect you and your child's privacy and security, we will take reasonable steps to help verify your identity before granting you access to the personal information that we collect and maintain about you or your child.
